Plant Care Terms of Service

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. Account Registration

To access certain features, you may need to create an account using a supported authentication method (such as Google or email). You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

3. Subscription Plans and Billing

Plant Care may offer free and paid subscription tiers (including, without limitation, Free, Pro, and Elite plans). Paid subscriptions are billed through our third-party payment processor, Stripe, under the pricing and billing terms shown in the app at the time of purchase. By starting a subscription, you authorize Robopioneer and Stripe to charge the applicable fees to your selected payment method on a recurring basis until you cancel.

Taxes, where applicable, may be added to the subscription price. You may cancel your subscription at any time via the account or billing management screens provided in the app or via Stripe's customer portal. Cancellation will take effect at the end of your current billing period; we generally do not provide refunds for partial billing periods, except where required by applicable law.

4. Acceptable Use

You agree not to misuse the Service. In particular, you will not:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorized access to the Service, other users' accounts, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Upload or transmit content that is abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Use automated tools (such as bots or scrapers) to access the Service in a way that imposes an unreasonable load on our infrastructure.

5. Plant & Health Information Disclaimer

Plant Care provides recommendations about plant identification, watering schedules, and related care based on data you provide and external data sources (such as weather information and AI models). The Service is intended for informational and convenience purposes only and does not constitute professional horticultural, agricultural, or veterinary advice.

You remain solely responsible for decisions about how you care for your plants or any environment in which they are kept. Robopioneer does not guarantee that your plants will remain healthy, survive, or perform in any particular way as a result of using the Service.

6. Third-Party Services

The Service integrates with third-party providers, including but not limited to Firebase Authentication (Google), Stripe (payments), Neon (database), weather APIs, and AI providers (such as Google Gemini or similar). Your use of these services may be subject to the separate terms and privacy policies of those third parties. Robopioneer is not responsible for the acts or omissions of such third parties.

7. Intellectual Property

The Service, including all software, user interfaces, visual design, logos, and content (excluding your data), is owned by Robopioneer or its licensors and is protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use in accordance with these Terms.

8. User Content

You may provide content to the Service, such as photos of plants, plant information, notes, or chat messages ("User Content"). You retain ownership of your User Content, but grant Robopioneer a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content as necessary to operate and improve the Service.

You represent and warrant that you have all rights necessary to submit the User Content and that your User Content does not infringe or violate any third-party rights or any applicable law.

9. AI Features

Some features of Plant Care use AI models to generate suggestions, explanations, or other outputs. AI outputs may be incorrect, incomplete, or not suitable for your specific situation. You should review AI-generated content carefully and use your own judgment before acting on it. Robopioneer is not liable for decisions you make based on AI-generated content.

10. Service Changes and Availability

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including adding or removing features, imposing usage limits, or restricting access to some or all users. We will make reasonable efforts to provide advance notice of material changes where practical.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service (including any paid subscription) if we reasonably believe that you have violated these Terms, misused the Service, or engaged in fraudulent or illegal activity. Upon termination, your right to access or use the Service will immediately cease, but sections of these Terms that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will continue to apply.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Robopioneer does not warrant that the Service will be uninterrupted, secure, or error-free, or that it will meet your expectations or requirements.

13. Limitation of Liability

To the maximum extent permitted by law, Robopioneer and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content.

In no event will the total liability of Robopioneer for all claims relating to the Service exceed the greater of (i) the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred Canadian dollars (CAD $100), to the extent permitted by law.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada, except where applicable law provides you with mandatory consumer rights to bring claims in your local jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice within the Service. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
